Community Founder Terms of Service

The platform agreement between CrystalPrivacy and the individual or entity that establishes and operates a community.

Please read these Terms carefully. These Community Founder Terms of Service (“Terms”) govern the relationship between CrystalPrivacy (“CrystalPrivacy,” “Platform,” “we,” “us,” or “our”) and the individual or entity that establishes and operates a community on the CrystalPrivacy platform (“Community Founder,” “Founder,” “you,” or “your”). By submitting a request to start a community, executing a Community Agreement, or operating a Community on the Platform, you agree to be bound by these Terms.

01Definitions

  • “Platform” means the CrystalPrivacy service, including CrystalPrivacy.com, the CrystalVerify and CrystalTrust applications, and all associated infrastructure and trust-validation services.
  • “Community” means the private, referral-validated community that you establish, configure, and operate on the Platform under these Terms.
  • “Members” means individuals admitted to your Community who use CrystalVerify to invite and validate others.
  • “Patrons” means individuals vouched for by a Member who use CrystalTrust to accept invitations and generate validation codes.
  • “Community Agreement” means the order form or subscription schedule executed between you and CrystalPrivacy that specifies the platform subscription rate, billing interval, and other commercial terms for your Community.
  • “Participants” means Members and Patrons collectively.

02Founder Eligibility

To become and remain a Community Founder, you represent and warrant that:

  • You are at least eighteen (18) years of age and have the legal capacity to enter into a binding agreement, or you are a duly organized legal entity in good standing;
  • You have the authority to bind the Community you operate and, if applicable, the entity on whose behalf you act;
  • You are not prohibited from operating the Community under the laws of your country of origin, your country of residence, or any jurisdiction in which your Community operates; and
  • All information you provide in your community request and Community Agreement is accurate and complete.

03The Founder’s Role and Responsibilities

The Community Founder is the owner and operator of the Community. The Platform provides trust-validation and configuration services; you are responsible for everything that makes the Community a community. Specifically, you agree to:

  • Build and grow your Community. You are solely responsible for recruiting your founding Members, fostering growth through vouched referrals, and sustaining Member engagement. The Platform does not recruit, market to, or supply Participants on your behalf.
  • Define and enforce Community rules. You will establish rules of conduct for your Community that are consistent with these Terms and applicable law, and you will enforce them among your Participants.
  • Ensure all Participants are adults. Every Member and Patron of your Community must be at least eighteen (18) years of age (or the age of legal majority in their jurisdiction, whichever is greater). You must not knowingly admit, invite, or permit any person under 18 to participate, and you must promptly remove any Participant you learn is underage.
  • Operate lawfully. You are responsible for ensuring your Community’s purpose and activities comply with the laws of every jurisdiction in which it operates, including obtaining any licenses or permits your Community’s activities may require.
  • Serve as point of contact. You will maintain current contact information with CrystalPrivacy and respond in a timely manner to Platform communications regarding your Community.

04Platform Services

Subject to these Terms and your Community Agreement, CrystalPrivacy will provide:

  • Configuration of your Community, including membership tiers and the features each tier unlocks;
  • Referral-based trust validation through the CrystalVerify and CrystalTrust applications, in which trust travels as anonymous, single-use codes and no personal data about Participants is exchanged or collected;
  • Tools to configure and manage Member access, including any membership tiers you choose to offer; and
  • Launch support and ongoing platform maintenance.

The Platform validates trust between Participants; it does not verify Participant identity, conduct background checks, or vouch for any Participant’s character, qualifications, or legality of conduct. Vouching is performed solely by your Members.

05Fees and Community Pricing

Your Community operates on a recurring platform subscription, and you determine how your Community is offered to your Members.

5.1 Platform Subscription

  • You pay a recurring platform subscription for your Community at the rate and billing interval specified in your Community Agreement. There is no revenue-sharing arrangement between you and CrystalPrivacy.
  • Platform subscription fees are billed in advance and are non-refundable except as required by law or as expressly stated in your Community Agreement.
  • We may change platform subscription rates on at least thirty (30) days’ written notice, effective at the start of your next billing period. Your continued operation of the Community after that date constitutes acceptance of the revised rate.
  • Non-payment after notice may result in suspension or termination of your Community under Section 11.

5.2 How You Provide Your Community to Members

  • You decide whether membership in your Community is offered free of charge or for a fee, and you set any pricing, tiers, and terms that apply to your Members.
  • If you charge your Members, you collect those payments directly. The Platform does not collect, process, hold, or remit Member payments on your behalf, and does not act as your payment processor, merchant of record, or agent.
  • You are solely responsible for your own billing arrangements, including payment processing, invoicing, renewals, refunds, chargebacks, and any applicable sales, use, or value-added taxes on amounts you collect.
  • You are solely responsible for resolving billing and refund disputes with your Members.
  • Any membership terms you present to your Members must be consistent with these Terms and must not conflict with the end-user terms applicable to Participants.

5.3 General Payment Terms

  • Amounts payable to CrystalPrivacy are exclusive of taxes. You are responsible for any taxes arising from your platform subscription, other than taxes on CrystalPrivacy’s net income.
  • You are responsible for any income or business taxes owed on revenue your Community generates.
  • You must not represent to Members or any third party that CrystalPrivacy is a party to, or responsible for, any payment arrangement between you and your Members.
  • We may suspend your Community for unpaid platform subscription fees, suspected fraud, or material breach of these Terms, pending resolution.

06Prohibited Uses

You must not use the Platform or operate your Community, and must not permit your Participants to use your Community, for any of the following:

  • Illegal activity. Any practice or activity that is currently deemed illegal in your country of origin, in your country of residence, in any jurisdiction in which your Community or its Participants operate, or under the laws of the United States;
  • Marketing or advertising platform. Operating, promoting, or presenting your Community as a marketing or advertising platform. Communities exist to build trusted membership — not to advertise, promote, or sell third-party products or services to Participants, distribute commercial solicitations, or harvest an audience for promotional purposes;
  • De-anonymization. Attempting to identify, profile, track, or collect personal data about Participants, or to defeat, reverse-engineer, or circumvent the Platform’s anonymity and trust-code mechanisms;
  • Harm to minors. Admitting or targeting persons under 18, or operating any Community whose content or purpose exploits or endangers minors in any way;
  • Fraud and misrepresentation. Misrepresenting your Community’s purpose, membership, or affiliation; impersonating any person or entity; or using the Platform’s trust validation to lend false legitimacy to fraudulent schemes;
  • Abuse of the trust system. Selling, trading, or distributing invitations, trust codes, or vouches to persons a Member cannot personally vouch for, or otherwise gaming the referral chain;
  • Platform interference. Introducing malware, attempting unauthorized access to Platform systems or other communities, scraping Platform data, or interfering with Platform operation; and
  • Facilitation. Encouraging or assisting any Participant or third party to do any of the above.

We reserve the right to investigate suspected violations, suspend or terminate offending Communities, and cooperate with law enforcement where required by law.

07Participant Relationships

Your Participants’ use of the CrystalVerify and CrystalTrust applications is governed by the applicable end-user terms. You acknowledge that:

  • You are responsible for the conduct of your Community and the rules governing it; the Platform is responsible only for the services described in Section 4;
  • Disputes between you and your Participants, or among Participants — including any billing, refund, or chargeback dispute arising from fees you charge your Members — are your responsibility to resolve; and
  • You will not make representations to Participants about the Platform beyond those published by CrystalPrivacy.

08Privacy and Data

The Platform is designed so that no personally identifying information about Participants is collected or exchanged; trust travels as anonymous codes between applications. You agree not to introduce personal-data collection into your Community’s use of the Platform, and to comply with all applicable privacy and data-protection laws in any data practices you conduct outside the Platform. CrystalPrivacy’s handling of the information you provide as a Founder (such as your name, contact details, and payment information) is described in our Privacy Policy at crystalprivacy.com/resources.

09Intellectual Property

  • Platform IP. CrystalPrivacy retains all right, title, and interest in the Platform, the CrystalVerify and CrystalTrust applications, and all related trademarks, software, and technology. You receive only a limited, non-exclusive, non-transferable right to use the Platform to operate your Community during the term of these Terms.
  • Founder IP. You retain ownership of your Community’s name, branding, and content you create. You grant CrystalPrivacy a non-exclusive, royalty-free license to use your Community name and configuration solely as necessary to provide the Platform services.
  • Publicity. Neither party will use the other’s name or marks in public marketing materials without prior written consent.

10User-Generated Content

Your Community may allow you and your Participants to upload images and other content (“User-Generated Content” or “UGC”). You are responsible for all UGC uploaded to your Community, including UGC uploaded by your Participants. You agree, and you must require your Participants to agree, that:

  • Ownership required. Participants may upload only images and content that they own or are otherwise fully authorized to upload. No one may upload any image or content they do not own or hold the necessary rights and permissions to use.
  • No infringement. UGC must not infringe or violate any copyright, trademark, right of publicity, privacy right, or other intellectual property or proprietary right of any person or entity.
  • Rights and consent. Where an image depicts a person, the uploader must have that person’s consent to upload and display it, and every depicted person must be at least eighteen (18) years of age.
  • Lawful content. UGC must comply with these Terms, your Community’s rules, and all applicable laws, and must not include any content prohibited under Section 6.

Platform not responsible. CrystalPrivacy does not create, own, endorse, pre-screen, or control UGC, and is not responsible or liable for any UGC uploaded to any Community, including its accuracy, legality, ownership, or any infringement it may cause. Responsibility for UGC rests entirely with the Founder and the uploading Participant. CrystalPrivacy may, but is not obligated to, remove UGC or suspend any Community or Participant in response to a complaint, suspected infringement, or violation of these Terms, and will respond to valid intellectual-property complaints (including notice-and-takedown requests) in accordance with applicable law. You are responsible for handling UGC-related complaints arising within your Community and for cooperating with any takedown the Platform is legally required to perform.

11Term, Suspension, and Termination

These Terms take effect when you execute a Community Agreement or begin operating a Community, and continue until terminated. Either party may terminate for convenience with thirty (30) days’ written notice, subject to any minimum term in your Community Agreement. We may suspend or terminate your Community immediately if:

  • You materially breach these Terms, including the Prohibited Uses in Section 6;
  • Your Community is used for unlawful activity or creates legal exposure for CrystalPrivacy or Participants; or
  • Required fees remain unpaid after notice.

Upon termination: (a) your right to operate the Community on the Platform ceases; (b) prepaid platform subscription fees are non-refundable except as required by law or as stated in your Community Agreement, and any fees accrued through the effective date of termination remain due; (c) you remain solely responsible for your obligations to your Members, including any refunds owed on fees you collected from them; and (d) Sections 6, 8, 9, 10, 12, 13, and 14 survive termination.

13Limitation of Liability

14Indemnification

You agree to indemnify, defend, and hold harmless CrystalPrivacy and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your operation of the Community; (b) the conduct of your Participants within your Community; (c) your violation of these Terms, including any Prohibited Use; or (d) your violation of any law or the rights of any third party.

15Changes to These Terms

We may revise these Terms from time to time. If we make material changes, we will provide notice by email or through the Platform at least thirty (30) days before the changes take effect, where practicable. Changes to the commercial terms in your Community Agreement require mutual written agreement. Your continued operation of a Community after the effective date of revised Terms constitutes acceptance.

16Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Platform shall be brought exclusively in the state or federal courts located in Wyoming, and both parties consent to the personal jurisdiction of those courts.

17General Provisions

  • Entire Agreement. These Terms, together with your Community Agreement and our Privacy Policy, constitute the entire agreement between you and CrystalPrivacy regarding your Community. In the event of conflict, the Community Agreement controls as to commercial terms.
  • Independent Contractors. You and CrystalPrivacy are independent contractors. These Terms create no partnership, joint venture, agency, franchise, or employment relationship.
  • Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
  • No Waiver. Failure to enforce any provision is not a waiver of the right to do so later.
  • Assignment. You may not assign these Terms or transfer your Community without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Force Majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control.
